Terms of Service
Rubicon, a product under Van Orton Recovery · Last revised: October 17, 2026
These Terms of Service (the “Terms”) are a legally binding agreement between you (“you,” “your,” or “Member”) and Van Orton Recovery, LLC, a Delaware limited liability company (“Van Orton,” “Rubicon,” “we,” “us,” or “our”). Rubicon is a product under Van Orton Recovery, LLC, which provides the Service and is your contracting party. These Terms govern your access to and use of the Rubicon website, subscription membership, and related services (together, the “Service”).
By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Section 16 contains a binding arbitration agreement and a class-action waiver that affect your legal rights; please read it carefully.
1. Eligibility
You must be at least 18 years old, a resident or citizen of the United States, and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is true, accurate, and complete. The Service is offered only where permitted by law and covers fraud involving cryptocurrency or any fiat payment method, including wire and ACH transfers, card payments, payment apps, checks, gift cards, and cash, with reported losses of US$1,000 or more.
2. What Rubicon does
Rubicon is an online fraud investigation, asset tracing, and recovery coordination service for losses involving cryptocurrency or any fiat payment method. You can open a case with the records you have; a complete case file is not required at signup. Subject to your subscription and cooperation, we:
- collect and analyze the evidence you provide;
- trace the movement of funds using the relevant blockchain, bank-transfer, and other payment records;
- investigate and identify the laundering methods used by the fraudsters;
- monitor the identified trail throughout your active membership for new movement, leads, and opportunities to pursue recovery;
- coordinate and liaise with cryptocurrency exchanges, banks, financial institutions, law enforcement, regulators, and other relevant third parties;
- prepare a documented money trail, a case file, supporting reports, and recovery requests, and provide updates showing findings, action taken, and next steps; and
- provide general personalized cybersecurity guidance relating to your case.
We complete asset tracing and begin recovery efforts within 24 hours of receiving your case evidence. Updates and messages are available through your dedicated client portal as the Rubicon team posts them. We also send account and case communications by email. This service milestone concerns tracing and the start of recovery work; it does not specify the date funds will be returned. We provide the Service on a reasonable-efforts basis. The specific work performed on any case is determined in our professional judgment based on the facts available.
3. What Rubicon is not
- Not a guarantee of recovery. We do not and cannot guarantee that any assets will be recovered, in whole or in part (see Section 9).
- Not a law firm. We do not provide legal advice, and no attorney-client relationship is created by your use of the Service.
- Not financial or investment advice, and not a broker-dealer, investment adviser, bank, money transmitter, or government agency.
- Never a custodian of your assets. We do not take possession or control of your funds, wallets, or accounts, and we will never ask for your wallet seed phrase, private keys, passwords, remote access to your computer, or an additional payment to “verify” or “release” funds. Any recovered assets are returned to you directly by the exchange, institution, or authority holding them.
Fraud victims are frequently targeted a second time by fake “recovery” services. We communicate only from addresses ending in @vanortonrecovery.com or @rubicon.vanortonrecovery.com. Be cautious of anyone asking for wallet credentials, remote access to your computer, or unexpected payments said to be needed to verify or release funds. If in doubt, contact us before responding.
Remote access to your computer is not required. You provide the records you choose through your account.
4. Your account and responsibilities
You are responsible for the activity under your account and for keeping your login credentials secure. You agree to:
- provide documentation reasonably sufficient to substantiate your ownership of the lost assets, including transaction records, wallet addresses, wire or ACH transfer confirmations, relevant account information, and, where requested, identity verification;
- cooperate with us and promptly provide additional information or materials we reasonably request, and you acknowledge that delays or inaccuracies may affect timelines and outcomes; and
- use the Service only for your own genuine fraud-recovery matter and in compliance with all applicable laws.
5. Membership, billing, and auto-renewal
- Free trial and amount due today. The standard introductory offer for first-time Members is $0 due when activating a 7-day free trial, followed by US$200 per month. Creating an account does not start your trial or subscription. We collect your payment method when you activate your membership through Checkout but do not charge it during the trial. A returning Member who has already had a subscription does not receive another free trial; Checkout shows any amount due today before confirmation.
- Price and term. The standard membership is US$200 per month. Applicable taxes may be added. Stripe shows your applicable rate and amount due before you subscribe.
- No minimum commitment. There is no minimum number of months, large upfront service bill, or fixed engagement fee. Your membership automatically renews each month at the rate shown at Checkout (or the rate already attached to your existing subscription) until you cancel or your funds are recovered. By subscribing you authorize these recurring charges.
- Price changes. We may change the price with at least 30 days’ advance notice; changes apply to the next renewal after the notice period.
- Failed payments. If a charge fails, we may retry it and may suspend or terminate your membership until payment is received.
- Taxes. You are responsible for any taxes associated with your membership other than taxes on our net income.
6. Cancellation
You may cancel at any time, with no minimum term and no cancellation fee, through Membership in your client portal (Billing on mobile), then Manage billing & subscription, or by emailing hello@vanortonrecovery.com. Cancellation stops future renewals. It does not automatically submit a refund request; guarantee refunds are requested separately as described in Section 7. If you cancel during an applicable free trial, you are not charged at all. If you cancel after the trial, your membership and access remain active until the end of the billing month you have already paid for, after which it ends. Except as expressly stated in Section 7, payments already made are non-refundable and we do not provide partial-month or prorated refunds.
7. 30-Day Money-Back Guarantee
We offer a limited money-back guarantee to first-time Members:
- What it covers. If you are a first-time Member and you cancel and request a refund within thirty (30) days of your first membership payment, we will refund your first monthly membership fee. This 30-day window starts when your first monthly membership fee is successfully charged. Any applicable free trial does not count toward the window.
- How to claim. Email hello@vanortonrecovery.com within the 30-day window and request the guarantee refund.
- Limits. The guarantee applies to the first month only and to one refund per person or household. It is not available on any re-subscription or additional account.
- When it does not apply. The guarantee is void if, on your case, a freeze or recovery of assets has already been secured or is actively in progress, or in cases of fraud, abuse, payment chargeback, or breach of these Terms.
- Separate “unable to begin” refund. If we determine, in our reasonable judgment, that we cannot begin tracing your case at all, we will refund the fees you have paid for that case, whether or not the 30-day window has passed.
Refunds are issued to your original payment method and may take several business days to appear. The money-back guarantee is not, and does not imply, any guarantee that assets will be recovered.
8. Recovered funds and no success fee
Your monthly membership at the rate shown at Checkout is the only service fee, plus any applicable taxes disclosed at checkout. There are no hidden service fees or additional charges said to be needed to “verify” or “release” your funds. Your subscription ends automatically when your funds are recovered. We do not charge any success fee, contingency fee, commission, or percentage of any assets that are located, frozen, or recovered. Recovered assets are returned to you directly by the relevant exchange, institution, or authority; we never take custody of them.
9. No guarantee of recovery
Asset recovery is inherently unpredictable and depends on factors outside our control, including the conduct of exchanges, financial institutions, courts, law enforcement, and other third parties, the behavior of the fraudsters, and changes in law. We make all reasonable efforts to increase the probability of recovery, but we make no representation, warranty, or guarantee of any specific outcome. Any firm or individual that guarantees recovery is not acting legitimately. Statistics and past results described on our website are illustrative and are not a prediction of results in your matter.
10. Authorization and consent to act on your behalf
You authorize us to act on your behalf in communications and negotiations with cryptocurrency exchanges, banks, financial institutions, law enforcement, regulators, and other third parties as reasonably necessary to support recovery of your assets, and to disclose your relevant information to those parties for that purpose (see our Privacy Policy). You agree to provide any additional documentation reasonably required to facilitate this. You may withdraw this authorization prospectively by canceling and notifying us in writing.
11. Confidentiality and intellectual property
We treat your case information as confidential and use industry-standard measures to protect it, as described in our Privacy Policy. The reports, trace maps, analyses, and other work product we prepare (the “Deliverables”) remain our intellectual property; we grant you a personal, non-exclusive, non-transferable license to use and share the Deliverables with law enforcement, banks, cryptocurrency exchanges, financial institutions, your own legal advisors, and immediate family for the purpose of pursuing your recovery. You may not resell the Deliverables or provide them to other asset-recovery services or media outlets. Nothing in these Terms restricts your right to share your honest opinion or review of the Service.
12. Acceptable use
You agree not to: use the Service for any unlawful purpose or to submit a matter that is not your own genuine claim; provide false, misleading, or fraudulent information; attempt to gain unauthorized access to the Service or interfere with its operation; scrape or copy the Service by automated means; or use the Service to launder, conceal, or recover assets connected to your own unlawful conduct. Violation may result in immediate suspension or termination without refund.
13. Compliance
We comply with applicable laws and regulations, including financial-crime, sanctions, and privacy rules. We adhere to Know-Your-Customer and Anti-Money-Laundering practices where required, may screen users and matters against sanctions and watch lists, and may decline or discontinue service and report activity where necessary to comply with law.
14. Disclaimers
THE SERVICE AND ALL CONTENT AND DELIVERABLES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ASSETS WILL BE RECOVERED. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
15. Limitation of liability and indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAN ORTON AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOST ASSETS, LOST PROFITS, OR THE ACTS, OMISSIONS, OR DELAYS OF THIRD PARTIES (INCLUDING EXCHANGES, BANKS, INSTITUTIONS, OR LAW ENFORCEMENT). OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, WHICH MAY NOT APPLY TO YOU.
You agree to indemnify and hold Van Orton harmless from claims, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your breach of these Terms, your violation of law, or any unlawful or unauthorized activity connected to the assets that are the subject of your matter.
16. Dispute resolution: arbitration and class-action waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before starting an arbitration, you agree to contact us at hello@vanortonrecovery.com and give us 30 days to resolve the dispute in good faith.
Binding arbitration. Any dispute not resolved informally will be resolved by final and binding arbitration administered by JAMS under its applicable consumer arbitration rules, before a single arbitrator, rather than in court. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. Disputes will be conducted only on an individual basis. You and Van Orton waive any right to bring or participate in a class, collective, or representative action.
Small-claims carve-out. Either party may instead bring an individual claim in small-claims court if it qualifies.
30-day opt-out. You may opt out of this arbitration agreement by emailing hello@vanortonrecovery.com with your name and account email within 30 days of first accepting these Terms; opting out does not affect the other provisions.
17. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Subject to Section 16, the state and federal courts located in Delaware have exclusive jurisdiction over any matter not subject to arbitration.
18. Force majeure
Neither party is liable for any delay or failure to perform due to events beyond its reasonable control, including acts of God, natural disasters, war, cyberattacks, or governmental actions.
19. Changes, termination, and general
We may update these Terms; material changes take effect on the date posted, and your continued use of the Service constitutes acceptance. We may suspend or terminate the Service or your account for breach of these Terms or as required by law. If any provision is held unenforceable, the remaining provisions stay in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
